These Terms and Conditions apply to all purchases made from Brainchild Posters (“we,” “us,” or “our”), a company registered in Denmark. By placing an order on our website, you confirm that you have read, understood, and agree to these terms.
1. General Information
• Brainchild Posters is a Danish company, and all transactions are governed by these Terms and Conditions.
• We do not have a physical presence in the United States, and our liability is limited as described in Section 12.
• The address used for shipping and returns is not a customer service or retail location. It is a fulfillment address used solely for processing shipments, and customers cannot visit this address.
• If you do not agree to these terms, please do not use our website or purchase our products.
2. Orders and Payment
• All prices are listed in USD and include applicable taxes unless otherwise stated.
• We accept Visa, MasterCard, American Express, and other secure payment methods.
• Your payment will be processed at the time of purchase. Orders are subject to availability, and we reserve the right to cancel any order.
• Sales tax may be applied where required by law. Customers are responsible for complying with any applicable tax laws in their state.
3. Shipping and Delivery
• We ship exclusively to U.S. addresses using trusted carriers such as UPS and FedEx.
• Standard delivery time is 2-5 business days, depending on location.
• Once your order has shipped, we are not responsible for delays caused by the carrier.
• You will receive a tracking number once your order has been dispatched.
• Shipping and Return Address: The address used for shipping and returns is a fulfillment address in California, USA, and not a retail or customer service location. Customers cannot visit this address
4. Returns and Refunds
• You may return unused products within 30 days of receipt.
• Products must be returned in original condition and packaging to be eligible for a refund.
• Customers are responsible for return shipping costs, except in cases of damaged or defective products.
5. Damage Claims (Transport Damage)
• If your order arrives damaged, you must report it within 7 days of delivery.
• To process a claim, please email hello@brainchildposters.com with:
1. A photo of the damaged product
2. A photo of the front of the package (all four corners visible)
3. A photo of the back of the package (all four corners visible)
4. A photo of the internal packaging (bubble wrap, air cushions, etc.)
5. A clear photo of the shipping label
• Once we receive your claim, we will evaluate it and offer a replacement or refund depending on the circumstances.
6. Cancellations
• Orders can only be canceled before they have been shipped.
• If an order has already been shipped, the customer must follow the return process outlined in Section 4.
7. Intellectual Property Rights
• Brainchild Posters is a registered trademark, and all designs are protected by copyright law.
• Our designs may not be copied, reproduced, or used for commercial purposes without written permission.
8. Limitation of Liability
• Brainchild Posters is not liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products.
• We do not guarantee that our products are fit for a particular purpose.
• Under no circumstances shall our total liability exceed the amount paid for the product in question.
• By purchasing from us, you agree not to pursue legal action against Brainchild Posters in any U.S. court.
9. Dispute Resolution & Arbitration Clause
• All disputes shall be resolved through binding arbitration in Denmark.
• Customers waive their right to file a lawsuit or participate in class-action suits in the United States.
• Arbitration shall be conducted under Danish law, and the decision shall be final and binding on both parties.
10. Force Majeure
• Brainchild Posters is not responsible for delays or failures due to circumstances beyond our control, including but not limited to:
• Natural disasters
• Strikes or labor disputes
• Supply chain disruptions
• Government regulations or pandemics
11. Changes to Terms and Conditions
• We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting on our website.
• Continued use of our website constitutes acceptance of the updated terms.
12. Governing Law & Jurisdiction
• These Terms and Conditions are governed by the laws of Denmark.
• Any legal matters shall be handled in Danish courts, and we do not submit to U.S. jurisdiction.
